The client’s case

A real estate professional acting for a family relocating from overseas was instructed on the purchase of a spectacular £2m+ home in South Oxfordshire. On the surface, everything appeared straightforward. The title plan looked correct, the property had been extensively modernised, and the transaction was progressing towards a tight exchange deadline.

The discovery

The risk

The seller initially downplayed the issue, explaining that the strip was only around a metre wide and that relations with the neighbours were excellent.

From a conveyancing perspective, however, neighbourly goodwill is not a legal solution.

If left unresolved, the ownership issue could have:

• Created a future boundary dispute.
• Affected mortgage ability and future saleability.
• Given a future neighbouring owner legal right over part of the extension.
• Resulted in costly and protracted litigation years after completion.

The solution

Rather than allowing the transaction to collapse, the conveyancer negotiated a practical solution that protected the buyers while keeping the transaction moving.

The agreed approach required:

• The seller to secure a transfer of the ransom strip from the neighbouring owner.
• An application for registration at HM Land Registry to be submitted before completion.
• Completion to take place with the Land Registry application pending, together with contractual obligations for the seller to deal with any subsequent requisitions until registration was completed.

This enabled the purchase to proceed while ensuring ownership of the extension would ultimately be regularised.

The outcome

The transaction exchanged and completed within the required timescales, with the legal issue identified, managed and resolved before it could become the buyers’ problem.
